Welcome to Textway. These Terms & Conditions ("Terms") govern your use of the Textway website and messaging services. By creating an account or using any part of our services, you agree to be bound by these Terms.
1. Services provided
Textway provides cloud-based Bulk SMS, WhatsApp Business API, Voice SMS / IVR, and Email messaging services to businesses operating in India and select international markets. All services are subject to applicable telecom regulations including TRAI, DLT and Meta WhatsApp Business policies.
2. Account registration
To use our services, you must register an account with accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.
3. Acceptable use
You agree NOT to use our services for:
- Sending unsolicited spam, phishing or fraudulent messages
- Promoting illegal goods, services or activities
- Distributing malware, viruses or malicious content
- Messaging customers without proper consent under DPDP Act and TRAI regulations
- Impersonating any person or entity, or misrepresenting your affiliation
- Sending content that is defamatory, obscene, hateful, or violates any third-partys rights
- Violating any applicable local, state, national or international law
We reserve the right to suspend or terminate accounts engaged in prohibited activity without refund.
4. DLT and regulatory compliance
For SMS services, you must register your sender ID, message templates, and entity details on the DLT (Distributed Ledger Technology) platform as mandated by TRAI. Textway will assist with the onboarding process but you are responsible for the accuracy of registered information and for obtaining required customer consent.
5. Pricing and payment
Pricing for our services is listed on our Pricing page and is subject to change with 30 days notice. Prepaid credits are non-refundable except where required by law. Invoices are issued in INR and applicable taxes (GST) will be added. Late payments may result in service suspension.
6. Service level and availability
We aim for 99.9% platform uptime but do not guarantee that the services will be uninterrupted or error-free. We are not liable for delivery failures caused by mobile network operators, recipient handset issues, or other factors beyond our reasonable control.
7. Intellectual property
All content, logos, trademarks, software and documentation on the Textway platform are owned by Textway or licensed to us. You receive a limited, non-exclusive licence to use the services for your business purposes only. You may not copy, modify, distribute or reverse-engineer any part of our platform.
8. Limitation of liability
To the maximum extent permitted by law, Textways aggregate liability for any claim arising out of or relating to these Terms or the services shall not exceed the amount paid by you to Textway in the three months preceding the claim. We are not liable for indirect, incidental, consequential or punitive damages.
9. Termination
You may close your account at any time by contacting support. We may suspend or terminate your access if you violate these Terms, fail to pay invoices, or if required by law. Upon termination, your right to use the services ceases immediately.
10. Governing law
These Terms are governed by the laws of India. Any dispute arising out of these Terms will be subject to the exclusive jurisdiction of the courts of Coimbatore, Tamil Nadu.
11. Changes to terms
We may revise these Terms from time to time. The latest version will always be posted on this page with the updated date. Continued use of the services after changes constitutes acceptance of the revised Terms.
